Probate is typically opened in the state where the decedent was domiciled at death. If your loved one lived in Howard County, Maryland probate is the primary proceeding. If they also owned real property in another state, a ‘ancillary’ probate may be needed in that state as well. We coordinate with out-of-state counsel when needed.
Does Maryland have an estate tax?
Yes. Maryland is one of a small number of states with both an estate tax and an inheritance tax. The Maryland estate tax applies to estates above a threshold ($5 million for deaths in 2026). The inheritance tax applies to bequests to anyone other than a close relative, at a 10% rate. We help estates plan around and properly report these taxes.
How are personal representative commissions calculated in Maryland?
Personal representatives are entitled to a commission set by statute, generally up to 9% on the first $20,000 of the estate, plus up to 3.6% on the balance, subject to court approval. We publish a free commission calculator for quick estimates.
What if I think the will isn’t valid?
Maryland recognizes several grounds for contesting a will, including lack of testamentary capacity, undue influence, fraud, and improper execution. Will contests have strict deadlines and require specialized handling. We represent both petitioners and personal representatives in contested matters.
